1. Introduction

These are the Terms and Conditions (“Testing Service Terms”) applying to the agreement between us (“Agreement”) in relation to your use of the Pelvic Relief vaginal microbiome testing service (“the Testing Service”), including the testing kit comprised within the Testing Service (“Testing Kits”). Please review these Testing Service Terms carefully before agreeing to them and let us know if you have any queries. 

2. Scope of the Testing Service

Please note: The Testing Service is not a substitute for medical advice. The reports generated by the Testing Service should be used as a screening tool by your Healthcare Provider to understand your vaginal microbiome in the context of your symptoms and health goals. The Testing Service is not a diagnostic test and the results are not intended for use alone as a means to cure, treat, prevent, diagnose or mitigate any disease or medical condition. Please ensure that you discuss the report with your Healthcare Provider and that you understand the report, your symptoms and the findings of your Healthcare Provider and their recommended treatment.

Your Healthcare Provider has ordered the Testing Service for you, and you will also have an agreement with your Healthcare Provider in relation to the terms under which they have obtained the Testing Service for you, the service they will provide to you in advising you on the results of the Testing Service, your rights to cancel etc. 

 

3. Using the Testing Service

Your Healthcare Provider is responsible for assessing you and ensuring that the Testing Service is suitable for use by you, having made a full assessment of your condition and any special needs. If you have any concerns, please contact us, or your Healthcare Provider, to discuss these.

The Testing Service is not intended for anyone aged under 18.  You must also live in the UK.

Please note that the success of the use of the Testing Service is entirely dependent on you following the instructions correctly and providing all information as requested and within 6 months of receipt of the Testing Service kit. It is your responsibility to ensure each of these things. 

Please refer to the instructions included in the Testing Service kit before taking your sample and contact us, or your Healthcare Provider, if you have any queries.

We aim to provide the results to your Healthcare Provider within around 10 to 14 days of receiving your sample, but there may be unexpected delays. While we will take all reasonable steps to try to meet this time limit, we cannot promise to do so. 

 

4. Changes to the Testing Service and/or Testing Kits

Please note that the Testing Service and/or Testing Kits may not exactly match that shown on our website/marketing materials.

We can always change the Testing Service and/or Testing Kits:

  • To reflect changes in relevant laws and regulatory requirements.

  • To make minor technical adjustments and improvements.

We can suspend supply of the Testing Service and/or Testing Kits to:

  • Deal with technical problems or make minor technical changes.

  • Reflect changes in relevant laws and regulatory requirements.

5. Use of your personal data

Your use of the Testing Service will require you to share certain personal data with us. 

Please see the Testing Service Privacy Policy , which sets out in detail how we will collect, store and use this data. 

6. Who we are

References in these Terms and Conditions to “Pelvic Relief”, “us” and “we” mean “Pelvic Relief”, the trading name of Elgenia Health Ltd., a company registered in England and Wales with company registration number 09833237. Our registered address is Upper Brockington, Bredenbury, Bromyard, Herefordshire HR7 4TH. Pelvic Relief ® is a registered trade mark of Elgenia Health Ltd.

8. If we need to contact you

If we need to contact you, we will do so in writing using the email or postal address provided in your order.

When we refer to "writing" or "written" in these Terms and Conditions, this includes email communication.

9. Your rights and remedies

We honour our legal duty to provide you with products and services that are as described to you on our website and that meet all the requirements imposed by law. 

As noted above, the success of the use of the Testing Service is entirely dependent on you following the instructions correctly and providing all information as requested. There are other, rarer circumstances in which a test may fail even for correctly collected samples. In such circumstances we will repeat the Testing Service free of charge. 

If you think there is something wrong with the Testing Service, please contact us as soon as possible (see contact details at Section 7).

We are not responsible for losses you suffer caused by us if the loss is:

  • Unexpected - It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).

  • Caused by a delaying event outside our control.

  • Avoidable - Something you could have avoided by taking reasonable action. 

However, nothing in these Testing Service Terms limits any liability for:

  • Death or personal injury caused by our negligence.

  • Fraud or fraudulent misrepresentation by us.

  • Breach by us of the terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession).

  • Any other liability that cannot be limited under English law.
